1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and the owner and operator of visitoceanbeachsandiego.com ("Site," "we," "us," or "our"). By accessing or using the Site in any way, you agree to be bound by these Terms. If you do not agree, you must immediately cease using the Site.

We reserve the right to modify these Terms at any time. We will post the updated Terms with a new "Last Updated" date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.

2. Description of the Site

The Site is an independent community guide to Ocean Beach in San Diego, California, providing informational content about attractions, events, businesses, travel tips, and related resources. The Site also allows businesses to advertise, property owners to submit rental listings, and visitors to sign up for a free email newsletter (which includes a downloadable Ocean Beach guide PDF) and to submit photos, events, and tips.

The Site is provided for general informational and community purposes only. We are not a travel agency, booking service, or real estate broker.

3. User Eligibility

The Site is open to general audiences and may be browsed by visitors of any age. However, to submit any content (including photos, events, tips, or rental listings), to advertise, or to enter into any paid transaction, you must be at least 18 years of age or the age of majority in your jurisdiction. By submitting content, advertising, or transacting, you represent and warrant that you meet this requirement. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

4. No Account Required

The Site does not require you to create an account, and we do not offer password-protected user accounts or memberships. Some features simply ask for an email address — for example, signing up for our free newsletter. You are responsible for the accuracy of any information you provide and for any content you submit.

5. Intellectual Property

Our Content: All content on the Site, including text, graphics, logos, images, photographs, videos, and other materials (collectively, "Site Content"), is owned by us or our licensors and is protected by United States copyright, trademark, and other intellectual property laws. By uploading or submitting any User Content, you represent and warrant that:

  • You own all rights in the User Content or have obtained all necessary permissions, licenses, consents, and releases from any third parties (including any individuals appearing in the photos) to grant the rights described below.
  • You have secured any required model releases or property releases for people or private property clearly identifiable in the photos.
  • Your User Content does not infringe any third party's copyright, trademark, privacy rights, publicity rights, or any other intellectual property or proprietary rights.
  • Your User Content complies with these Terms and all applicable laws.

You agree not to upload any copyrighted material (including photos, artwork, or logos) without express permission from the copyright owner.

You retain ownership of your User Content. However, by submitting User Content, you grant us and our affiliates, licensees, successors, and assigns a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly display, publicly perform, and exploit such User Content in any form, media, or technology now known or later developed. This includes using the content on the Site, in galleries, newsletters, social media, marketing materials, and promotional content related to Ocean Beach.

You waive any moral rights or rights of attribution you may have in the User Content, to the extent permitted by law.

We reserve the right (but have no obligation) to monitor, review, edit, or remove any User Content at our sole discretion. We are not responsible for any User Content submitted by users and do not endorse it.

DMCA Policy: We respect copyright owners. If you believe any content on the Site infringes your copyright, please send a DMCA notice to info@visitoceanbeachsandiego.com with all required information under the Digital Millennium Copyright Act.

6. User Conduct and Prohibited Activities

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable federal, state (including California), or local laws.
  • Submit content that is defamatory, infringing, obscene, harassing, or that violates third-party rights.
  • Attempt to gain unauthorized access to the Site, interfere with its operation, or engage in scraping or automated data collection without permission.

8. Advertising and Paid Listings

Businesses may purchase advertising or featured placement on the Site. Paid features, pricing, and billing terms are described at the point of purchase. Payments, if any, are processed by a third-party payment processor (Stripe); we do not store full payment card details. Purchasing advertising does not guarantee any particular result, ranking, or amount of traffic. We reserve the right to decline, edit, or remove any advertisement or listing at our discretion.

Rental Listings and Local Compliance: If you submit a short-term, long-term, or vacation rental listing, you are solely responsible for compliance with all local laws and ordinances. For properties within the City of San Diego, this includes holding and displaying a valid Short-Term Residential Occupancy (STRO) license and complying with Transient Occupancy Tax (TOT) collection requirements. We assume no liability for unauthorized, unpermitted, or unlicensed rental marketing.

Regulated products and services. Advertisements for regulated or age-restricted products and services — including alcohol, cannabis and CBD, tobacco and vaping, firearms, gambling, and adult content — are accepted only at our sole discretion and, where accepted, must comply with all applicable federal, state, and local laws and platform/payment-processor rules, including California advertising and age-restriction requirements. The advertiser is solely responsible for holding any required licenses and for the legality and accuracy of its advertising. We may require proof of licensing and may decline or remove any such advertisement at any time.

9. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Site will be error-free, secure, or uninterrupted. Information about beaches, events, businesses, tides, surf, parking, and conditions may change and may not always be accurate or current. Use of the Site and any information contained on it is at your sole risk; always confirm time-sensitive details with the official or primary source before relying on them.

Beach and Activity Risks: Ocean Beach and ocean activities involve inherent risks, including strong surf, rip currents, and changing water conditions. We are not responsible for any injuries, damages, or losses resulting from your use of the Site or any activities at Ocean Beach. Always follow posted signs and lifeguard guidance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability to you shall not exceed the greater of $100 or the amount you paid us (if any) in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Site;
  • Your violation of these Terms;
  • Your User Content; or
  • Any infringement of third-party rights by you.

12. Accessibility

We strive to make the Site accessible to all users and to follow recognized best practices, including general alignment with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. Accessibility is an ongoing effort, and we do not claim that the Site is fully conformant at all times. 13. Governing Law and Dispute Resolution

To the extent permitted by law, you waive any right to a jury trial and agree that any dispute resolution proceedings will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

14. Termination

We may terminate or suspend your access to the Site at any time, with or without cause. Sections that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification) will survive.

15. Miscellaneous

These Terms constitute the entire agreement between you and us. If any provision is held invalid, the remainder shall continue in full force. We may assign these Terms; you may not. No waiver of any breach shall constitute a waiver of any other breach.
